Applying for an Employer Identification Number (EIN) as a non-resident without an Individual Taxpayer Identification Number (ITIN) involves a few steps. Here's how you can do it:


 

1. Understand the Purpose of the EIN:

   - An EIN is primarily used for business entities, such as partnerships, corporations, and sole proprietorships, for tax filing and reporting purposes.

 

2. Determine Your Eligibility:

   - Ensure that your business requires an EIN. Generally, businesses with employees, those operating as corporations or partnerships, and those required to file certain tax returns will need an EIN.

 

3. Prepare the Necessary Information:

   - Business name and address

   - Type of entity (e.g., corporation, partnership)

   - Reason for applying for an EIN

   - Name of the responsible party (a person or entity that controls, manages, or directs the applicant entity and the disposition of its funds and assets)

 

4. Apply for an EIN:

   - Online: The IRS offers an online application process for EINs. However, it typically requires a Social Security Number (SSN), ITIN, or another EIN. Since you don't have an ITIN, this option might not be suitable unless you already have an SSN or another EIN.

   - By Fax or Mail: You can apply by completing Form SS-4, "Application for Employer Identification Number," and sending it to the IRS via fax or mail.

     - Mail: Mail the completed Form SS-4 to the address provided in the form instructions.

     - Fax: Fax the completed Form SS-4 to the appropriate IRS fax number listed in the form instructions. The IRS will fax back your EIN within a few days to a few weeks, depending on how busy the unit is during tax filing season.

 

5. Contact the IRS Directly:

   - Phone: If you face issues with the application process or need guidance, you can call the IRS directly at their International EIN Department. The phone number is 267-941-1099 (not a toll-free number). Be prepared for international calling charges and possibly long wait times.

   - Explain that you are a non-resident applying for an EIN and do not have an ITIN. The IRS representative can guide you through the process.

 

6. Follow Up:

   - After submitting your application, follow up if you do not receive your EIN within the expected timeframe. The IRS may request additional information or documentation.
